India is home to the second-largest population in the world but how about online gambling and gaming? So, it makes perfect sense for Indians to also make up one of the largest online audiences in the world. Online casinos and online gambling are quickly becoming entertainment hotspots for the Indian public. And we can read in Forbes reports that by next year i.e. 2022, the number of online gamers in India will increase to a whopping 510 million. That’s almost half of the country’s entire population! Young adults in India are engaging in online gaming and online gambling more than ever now, and there are a few reasons that can be associated with this rising trend.

Firstly, more Indians are getting internet access than ever before. Secondly, online gaming is highly addictive. And thirdly, online gaming is extremely lucrative and rewarding for Indian gamers. Unfortunately, not everything is sunshine and rainbows when it comes to the growth of online gaming in India, as it’s now being conflated with online gambling — a completely different, yet equally as popular, form of entertainment amongst Indians.

How India Defines Online Gaming

The perception that the general public has towards online gaming and online gambling in India is contingent upon the way these games are played. By definition, online gaming simply refers to the act of playing any kind of game on an online platform. But the issue isn’t quite as simple. In India, online games are divided into two broad classes; games of chance, and games of skill.

Games of chance, as the term suggests, are those online games that don’t require any specific set of personal skills for you to be able to play. The outcomes of such games are based on pure chance or luck, rather than the your expertise.

Games of skill, on the other hand, are dependent upon the your mental and physical expertise, knowledge, experience, and skills. So the outcomes of such games are determined by your performance.

Current Online Gambling Legislature

As per Indian law, games of chance are morally inappropriate due to the unfair circumstances that they are contingent upon. When players play games of chance, they don’t get a fair shot at success since the results of the game are predetermined or automated. Therefore, Indian government has banned Indian players from playing games of chance online, within Indian borders.
Indian legislature is quite confusing when it comes to the legality of online gaming and online gambling in the country. However, this is largely because the authorities fail to make a clear distinction between the two. Some might argue that there’s no need for differentiation but here’s why there definitely is.

The Need For Differentiation Between Online Gaming And Gambling

The main Indian laws that pass any kind of judgment on online gaming and/or online gambling were written into the constitution before online casinos even came around. So these outdated laws conflate online gaming and online gambling in India, making it difficult for modern-day authorities to appropriately regulate the two forms of entertainment.

So drawing a clear distinction between the two is important for multiple reasons. To begin with, it’ll help Indian live casino operators and their customers understand which live casino games are legal and which aren’t. Additionally, it’ll help the authorities identify shady practices in the online gambling space and effectively regulate them. And finally, it’ll protect Indian gamblers from falling prey to illegal online gambling activities.

However, the online gaming and online gambling markets in India are helping the economy grow rapidly. So the authorities shouldn’t let the industry suffer just because the present status of Indian legislation regarding online gambling still remains largely vague.
